Man needs help
Have been ‘ripped-Off’ by my Union/USPS, of my career job with the USPS as a honorable employee and Veteran of the USNavy(three times honorably served ‘terms’/ enlistments prior to the/my 18+ yrs(Again-All honorable)) by totally deceitfull, illegal practicing managers/union officials, all immediately after the/my factual report of being assaulted/sexually assaulted in the workplace by an ACTING supervisor, to ‘his’ manager. The gross negligence/insubordinate actions of the manager, refusing to comply with federal law (re-enforced/referenced with USPS regs/instruct) regarding the report) trying to ‘drum-up’ deceitfully thru obvious lies, a ‘wittness’ immediately after the report, ‘attempting’ to ‘close’ the reported matter within five minutes of the offense report. This ‘alone’ was the violation (with ‘added’/later. Written instruct/federal law dictates the separation of the two employees (remaining employed) and a ’separately assigned ‘unbiased’ assignment of two ‘other’ than assigned to the ‘particular’ facility to investigate the matter (again ‘unbiased’). ‘furthermore’, the so called ‘wittness’ situation was totally ‘contradicting’ to the later admitted ’scenario’. I was a mailhander, L-4, being ‘utilized’ as a ‘clerk’, L-6 casing ‘box-letter’ mail, as well as the supervisor who committed the crime (at level 15 ‘acting supervisor’ pay, for the ‘box-clerk’ was simply not there, nor was there any other clerk ‘there’, in which was the very same reason why management was ‘breaking away’ from complying with the Equal Pay Act. Yet the manager was ‘trying’ to ’say’ the matter was ‘closed’ (illegally/wrongfully as detailed) because he, at the same ‘time’ because the same ‘clerk’/a ‘clerk’ somehow ‘wittnessed’ that the assault/sexual assault was not ’seen’, therefor, did not happen. Now anyone with ‘common sense’ should ’see’ the contradiction(s) here, and should ‘know’ sensibly, that just because someone ’says’ they did not ’see’ something/an ‘incident’, doe not ‘prove’ that it did not happen, never-the-less the fact that, as sited previously here-in, this was totally ‘out-of-wack’ unlawfull procedure/not as per USPS instruct/federal law. All of the contained here-in this inquiry is all well documented in the/my EEOC (Equal Employment Opportunity Commission) filed complaint with the Office of Personnel Management, with most of the contained info ‘backed-up’ and supported by management, at different levels of the EEO/USPS investigation soon there-after initiated by me thru an EEO/USPS ‘informal’ to ‘formal’ complaint. I, of course, became painfully sick of the shock, etc., of all this, and the following day had to come to work with a ‘double-krik’ in my neck, from the stress of it all, plus I have/had been already suffering from severe/major depression, clinically diagnosed and was on prescribed medication (maximum dose of 60mlg) approx. from nine yrs. previous (9yrs) to and thru this incident(s) sited. I knew at the time that the manager was violating the law, so I, after requesting them more than eight (8) times the following day, he finally provided the appropriate CA2a US Dept. of Labor ‘On-the-Job’ injury report forms (Office of Workmans Compensation-OWCP), properly filling them out, ’siting’ everything here-in explained, as well as the managers illegal activity, in which obviously was making me sick/ill/injured, further. (copies of the CA2a forms are additionally in the already referenced EEOC file, ‘initialled’ by one of the supervisors. I beleive it was the following morning that even more illegal activity ‘entrenched’ itself by management (Arlington, VA. – USPS) The same manager, directly upon my report to duty the following morning, simply and additionally unlawfully, ‘ordered’ me off the premisses and ‘all of Arlington, VA. USPS premisses, ’somehow re’enforced’ by the USPS Inspection Service, (obviously thru some ‘furthered’ lies and deceitfull activity) They (USPS management) clearly were ‘covering-up’ with more lies and unlawfull action(s), the forementioned ‘lies and deceit/unlawfull’ action(s), all to ‘defend’ this supervisor, who has/had prior known incidences of this same type of thing (fighting/inappropriate touching, etc.) with an ‘arrest’ history for doing so. The ‘claimed’ reason they/the manager illegally ‘put-me-out-for’ was an illegal one as well. At the time (25MAY’07) I repetatively requested Union Representation and it was refused. The ‘reason’ he (the manager) stated he was doing this was ‘over’ a previous ‘issue’, in which ‘bottom-line’ was pure Age Discrimination. (I am presently 53 yrs old) I had addiitonally requested many times over this ‘added’ issue, Union Representation from the Postmaster AND Executive Postmaster MANY TIMES prior to the 25MAY’07 date of, for all effective pay purposses, my ‘immediate termination’. Prior to ‘all-this-already’ explained, I was being, ‘bottom-line’, harassed, purely ‘unwarrantedly’ to report, at my own expense, to ‘any’ physician and, thru this ‘physician’, request what is called ‘light-duty’,, for an ‘aging spine condition’ (osteoarthritis) that I had been diagnosed with in the past (over three years prior to with no problems/back injuries for I was removed from my craft (mailhandler) again, illegally, directly to the ‘medievil’ like working conditions ‘prevalently known’/nationwide thruout the USPS, i.e., the refusal of management to provide proper equipment/ working ‘environment’ conditions under ‘normal’ conditions, never-the-less ‘aging’ conditions. I even was willing to do ‘this’ (put thru their ‘demanded’ request for light duty, yet all four times I contacted the physician of choice, the physician insisted that the USPS, under the circumstances that they were proposeing, absolutely were to provide what they called a ‘Case Acceptance Letter’ (CAL). Each of the four times I detailed this to the Executive Postmaster/Postmaster, and they/the USPS simply refuseed to provide the same (CAL), obviously the’cause’ of the very same equated problem that they later accomplished in two ’successful’ attempts in ‘arbitration’, even after all this illegal activity detailed out to the arbitrator, to obtain my eventual ‘full’ termination of employ. Additionally, the Executive Postmaster, lieing, stated that I was somehow insisting I could not ‘do-the-job’, in which was even ‘reasserted’ that that was not true, and that ‘accommodation’ was and still is requested, as detailed above, not only under ‘normal’ conditions, but ‘aging conditons’, in my particular case, as well. My Union, clearly, was also extremely negligent. The National Postal Mailhandlers Union (AFL-CIO) should have filed, at minimum, 6 (six) separate Grievances dealing with, directly, not only with the Union contract, but the blatently obvious violations of Federal Law(s) broken regarding the ‘progress’ of this/my illegal termination of career USPS employment. More ‘proof’ of this illegal activity is ‘within’ the already referenced EEOC file, yet ‘all’ of the ‘officials’, at every level of the EEO/EEOC process did not seem to ‘grasp’ the reality of the contained ‘there-in’ proof, and clearly, negligently, ‘allowed’ the illegal termination, ’stand’. It is totally rediculous. And presently, this EEOC case is in an ‘Appeal’ status as of 08OCT08, the letter from EEOC detailing that I can, after six(6) months, file with the US District Court, if I wish (in which I do wish – most adamently – ) to do so. Of course, I desparately need Pro-Bono/Contingency Attorney/Lawyer. I am the victim here, and say here I am still suffering medically, and now even more, financially, from this most stressfull scenario detailed. I emphasize here and now, I do not ‘bear-false-wittness’, and most of detailed with the ‘hard-evidence’ within the referenced EEOC file is ‘irrefutable’. I need an Attorney/Lawyer and haven’t the funds to acquire one. In the meantime, the USPS also, illegally ‘acquired’ my immediate denial of Unemployment Benefits, as well, the pretty much same ‘way’, thru insisted ‘lies and illegal activity/deceit’. I am on the street(s) and homeless/broke with my life ILLEGALLY RUINED by these LAW-Breaking, clearly CRIMINAL USPS Managers, right here, ‘under the nose’ of the Lawmakers Themselves in Washington, D.C., in Arlington, VA. right accross the river from D.C. itself.
